Who is the Personal Data Controller?

Pursuant to Articles 13 and 14 of the General Data Protection Regulation of 27 April 2016 (GDPR), we hereby inform that one of the following entities acts as the Controller of your personal data:

  • Adamed Pharma S.A. with its registered office in Pieńków, ul. Mariana Adamkiewicza 6A, 05-152 Czosnów,
  • Adamed Group Foundation with its registered office at ul. Karowa 31A, 00-324 Warsaw.

Before commencing personal data processing activities, Adamed entities always identify the purpose and legal basis for the processing as well as determine the data retention period. Your personal data are processed:

  • due to performance of a contract between you and the Controller or steps necessary to enter into this contract (Article 6 paragraph 1 point b),
  • due to legal requirements which the Controller is obliged to comply with (Article 6 paragraph 1 point c),
  • due to a legitimate interest pursued by the Controller (Article 6 paragraph 1 point f),
  • on the basis of your consent (Article 6 paragraph 1 point a).

In each case, we use our best efforts to keep you informed about the purpose of personal data processing, the legal basis for such processing, the data retention period and any other issues required by the GDPR as a part of fulfilment of the information duty.

Who can contact the Data Protection Officer?

The Data Protection Officer was appointed for all Adamed entities pursuant to Article 37 of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation), hereinafter the Regulation or GDPR.

The Data Protection Officer, as a part of fulfilled tasks, ensures protection of rights and liberties of persons whose data are processed by Adamed. These persons can contact the Data Protection Officer with regard to all issues related with their personal data to the extent to which these data are processed by Adamed.

What issues is the Data Protection Officer in charge of?

The Data Protection Officer verifies the correctness of personal data processing within the organisation. As a part of their activities, they also act as the contact point for all reports in connection with possible irregularities in personal data processing. Therefore, you can contact the Data Protection Officer if, in your opinion, a data breach has occurred in any Adamed entity. The Data Protection Officer is also the entity to which requests for exercise of your rights should be addressed.

These rights concern in particular:

1)       The right of access to personal data,

2)       The right to their rectification,

3)       The right to erasure of personal data (“right to be forgotten”),

4)       The right to restriction of processing,

5)       The right to data portability,

6)       The right to object to further processing,

7)       The right to object to automated decision-making, including profiling,

8)       The right to communication of a personal data breach.

What is the procedure for the processing of your request?

A request may be submitted through a selected Adamed employee or directly to the Data Protection Officer. We will consider it immediately. If request execution takes longer than a month, you will be informed about the extension of the response deadline in a separate letter. Such an extension is possible due to complexity of the request or the number of requests submitted.

If the request prevents your explicit identification or is unclear, the Data Protection Officer will ask you to supplement it within one month of the request submission.

If the request is submitted electronically, further correspondence will also take place in this form if possible. In other cases, you will be informed about the form of request examination in writing, via registered letter with receipt confirmation.

Request examination is free-of-charge. However, if the request proves unjustified or is frequently repeated, the Personal Data Controller may (a) impose a reasonable fee, taking into account reasonable administrative costs associated with request examination, communication or execution of the requested operations or (b) refuse examination of the request.
